Overview

This guide provides practitioners, and in particular solicitors who advise publican clients and other licence holders on a regular basis and also who appear constantly before the District Courts for the various licences and exemptions, with a straight forward and easy to use account in relation to the various applications. A matter of huge concern to solicitors is the ever increasing field of professional negligence. The Guide will deal with the steps that must be taken with regards to the purchase or lease of a licensed premises. Reference only in passing will be made to applications for on licences which are made in the Circuit Court which are governed by statute and the Rules of the Circuit Court 2001. Under each chapter heading where appropriate, the relevant practice and procedure will be discussed. At the time of writing, the proposed legislation consolidating the seventy odd licensing statutes has been produced in bill form, but is not expected to become law until (according to officials in the Department of Justice) sometime in 2007 many of the general principles which presently apply will, continue to have relevance.
