This book analyzes the difficulties of applying foreign exchange regulations in the Democratic Republic of Congo, through a study of the role of the Central Bank of Congo (BCC) in the face of the phenomenon of street trading. It aims to demonstrate the mechanisms enabling the BCC to effectively supervise foreign exchange activities in order to ensure monetary and financial stability. The study first presents the institutional and regulatory framework for foreign exchange operations in the DRC, highlighting the essential missions entrusted to the BCC by the legislator, notably the regulation of monetary flows and control of the financial system. It emphasizes that the effectiveness of foreign exchange control is closely linked to the stability of monetary and foreign exchange policy. The book then examines the legal framework for foreign exchange trading, the conditions for licensing foreign exchange dealers and the disciplinary regime applicable in the event of infringement. It demonstrates that the control of foreign exchange transactions must be accompanied by dissuasive sanctions, while seeking a balance between repression, market efficiency and financial innovation, in order to reinforce the effectiveness of foreign exchange regulation in the DRC.
