OverviewMany Somali refugees from Somalia have been seeking refuge in neighbouring Kenya since the internal conflict in Somalia in the early 1990s. In 2016, the Kenyan government decided to close the largest refugee complex, Dadaab, where hundreds of thousands of refugees from Somalia were sheltered. Besides, Kenya decided to disband its own governmental refugee affairs agency. The decision by the Kenyan government was challenged through a suit in the Kenyan government which led to the suspension of the decision. Later in 2019, the Kenyan government again made a similar decision on grounds related to Kenyan national interest. This article investigates the legality of Kenya's decision in light of international agreements governing refugee affairs to which Kenya is a state party.
