How to Use This Handbook The FTC Mail, Internet, or Telephone Order Merchandise Rule is a shipping-promise rule. It requires a seller to possess a reasonable basis for the shipping time it represents, or for shipment within the default period when no time is stated. When the seller cannot ship on time, the Rule governs delay options, consent, cancellation, and prompt refunds for covered unshipped merchandise. The Rule does not create a universal federal right to return delivered, non-defective merchandise. It also does not convert a buyer's payment-card dispute into a seller's Part 435 defence or determine every post-shipment loss, damage, risk-of-loss, warranty, or marketplace issue. Those adjacent subjects are addressed only to classify the problem and direct the reader to the correct legal framework. This handbook follows the lifecycle of an order: coverage, shipping representations, properly completed orders, inventory and vendor controls, delay notices, consent, cancellation, refunds, payment disputes, post-shipment issues, and compliance governance. The operational forms are educational aids and are not official FTC forms. Source-Status Guide Class A - Federal statute: The FTC Act, Truth in Lending Act, Electronic Fund Transfer Act, ROSCA, and the unordered-merchandise statute. Class B - Binding regulation: 16 CFR Part 435 and, where applicable, 12 CFR §§ 1026.13 and 1005.11 and other legislative rules. Class C - Official interpretation: Official interpretations to Regulations Z and E and regulatory materials explaining a binding rule. Class D - Staff or business guidance: FTC business guides and consumer publications. They assist compliance but do not replace the rule text. Class E - Enforcement and judicial material: Complaints, orders, judgments, and decisions whose effect depends on their issuing body and posture. Class F - State or contractual overlay: State return-policy, sales, marketplace, automatic-renewal, gift-card, risk-of-loss, and consumer-protection law, plus carrier and marketplace contracts.
