English summary: On the Necessity and Implementation of an Independent Criminal Liability for the Operation of Digital Trading Platforms. A Critical Analysis of 127 StGB in the Light of Preparatory Criminal Law The dissertation deals with the new law created in 2021 on the criminal liability of operating criminal trading platforms on the Internet according to 127 StGB. The legislative process is reviewed and the specific law is analyzed and evaluated in the light of information technology, constitutional and criminal law dogmatics, criminology as well as practice-oriented aspects. Based on the formulated criticism, a separate draft law de lege ferenda is developed. German description: Die Arbeit befasst sich mit dem 2021 neu geschaffenen Gesetz zur Strafbarkeit des Betreibens krimineller Handelsplattformen im Internet nach 127 StGB. Der der Norm zugrundeliegende Gesetzgebungsprozess wird chronologisch aufgearbeitet und das konkrete Gesetz wird im Lichte der Informationstechnik, der Verfassungs- und Strafrechtsdogmatik, der Kriminologie sowie anhand praxisorientierter Gesichtspunkte analysiert und bewertet.Konkret wird etwa beleuchtet, was unter einer Handelsplattform zu verstehen ist, wo die begrifflichen sowie zeitlichen Grenzen des tatbestandlichen Betreibens zu ziehen sind, worin der Unrechtskern des kriminellen Handelsplattformbetriebs liegt, welche Straftaten in ausreichender Weise mit dem Betrieb in Verbindung zu bringen sind oder welche Auswirkungen der gewahlte Strafrahmen der Verbotsnorm auf ihre Auslegung hat. Auf der Grundlage der formulierten Kritik wird schliesslich ein eigener Gesetzesentwurf de lege ferenda entwickelt.
