OverviewThe new legal practice course marks a shift in focus, from the traditional book learning of the old course towards an emphasis on legal skills gained through practical exercises. This book on wills, probate and administration is part of a series which will provide a guide to the law, practice and procedure. Each guide will explain the relevant substantive and procedural law and where appropriate will contain sample precedents, documents and check lists as well as excerpts from relevant practitioner texts. Sample questions and execises will also be included as a stimulus to further reading. The guides will form a bridge between the notes and workbooks produced by each teaching institution and the raw material found in the practitioner texts. There is a guide for each of the compulsory subject areas and for many of the more common optional subjects. There is also a guide devoted to the pervasive subjects and two guides on the skill subjects. This book explains the basic law and procedures with which a probate practitioner needs to be familiar. It begins with a review of essential elements of the law of testate and intestate succession and of the taxation issues which impinge upon this area of practice. It then considers the various steps to be taken to obtain a grant of representation to a deceased's estate and, once this has been obtained, the process of winding up the estate.
