Positive law may be (1) international, or (2) national or state. International law, therefore, may be considered as positive law, inasmuch as its ultimate support is an appeal to arms. And although the appeal to arms may not be resorted to in every case, yet the fear Of incurring general hostility operates upon nations, keeping them within the rules of national comity.
