The English Legal Process

Overview

"This text is intended for students of the English legal system who are looking for a topical account of the more important institutions and practices of the legal process. Chapters on remedies are included to introduce students at an early stage to the major forms of redress available in both private and public law. Their inclusion should be helpful to the understanding of contract, tort, administrative law, property law and equity. The book should, therefore, also be useful to those readres who have advanced beyond the first stage of their course. This revised edition includes references to the Criminal Justice and Public Order Act 1994, the Police and Magistrates' Courts Act 1994, the Race Relations (Remedies) Act 1994, the Criminal Appeal Act 1995 and the Criminal Injuries Act 1995. Many new case law developments are incorporated, including: decisions on the secrecy of jury deliberations; guidance on jury awards of damages in libel actions; damages for mental distress; exemplary damages in tort; locus standi in judicial review proceedings; the giving of reasons for decisions; and the miscarriages of justic involving Mark Cleary, Eddie Browning, Kevin Callan, George Lond, Sam Hill, and the four men at the centre o the ""Arms to Iraq Affair"". Important pronouncements by the House of Lords are noted on a variety of subjects, including the commencement of legislation, the limits of judicial law-making, the relationship between English law and European Community law and applications for judicial review."
