Overview

This work provides an account of the most important institutions and practices of our civil and criminal justice systems. Subjects covered include courts and tribunals, juries, judicial precedent, statutory interpretation, appeals and miscarriage of justice, contempt of court, and chapters on remedies designed to familiarize students at an early stage, with the major forms of redress available in both private and public law. Intended for students of the English legal system at universities and colleges, this new edition has been updated to include references to Trade Union and Labour Relations (Consolidation) Act 1992, the Tribunals and Inquiries Act 1992, the Judicial Pensions and Retirement Act 1993, the Trade Union Reform and Employment Rights Act 1993, the European Communities (Amendment) Act 1993 and the Criminal Justice Act 1993. The principal recommendations of the Royal Commission on Criminal Justice are noted. The many new case law developments incorporated include decisions on liability for criminal contempt of court, guidance on jury awards of damages in libel actions, exemplary damages in tort, amenability to judicial review and the miscarriages of justice involving Derek Bentley, Judith Ward, the Darvell brothers, the Taylor sisters, the Cardiff three, Ivan Fergus and John Berry. The book also deals with important pronouncements by the House of Lords on a variety or subjects, including the relationship between English law and European Community law, the liability of ministers of the Crown for civil contempt of court, jury trial in civil cases, the use of Hansard as an aid to statutory interpretation, the retrospective effect of legislation, the civil rights of prisoners, the availibility of injunctions against the Crown and applications for judicial review.
