Excerpt from The American Flag: Declaration of Rights; Declaration of Independence The Constitution of California adopted in 1849, with its amendments of 1856, 1862. And 1871, was superseded by the new Constitution, adopted on the 7th day of May, 1879, which was intended to meet the advanced condition of the State and the requirements of a progressive com munity. For convenience of comparison, the compiler has collated the old and the new organic instruments, placing them side by side, that the reader may at a glance discover wherein they differ. Following this is the text of the new Constitution, each section of which is followed by a reference to the Constitutions of other States having similar provisions in their organic laws, the language of which in many instances is identical. In such cases, the decisions of the Supreme Courts of these States will be of great weight in settling the construction of the lan guage used in our own organic law. As.many of the changes were of a radical nature, the author has endeav ored to note all decisions of United States Courts and of the Supreme Courts of the various States which seem to bear upon the points involved in our new organic law. The notes, though greatly condensed, it is believed clearly express the ultimate principles decided by the courts in the cases referred to.
