Overview

This textbook is written for students with no previous training in law. Its intention is to present a challenging treatment of the law of contract. The book should, therefore, be particularly useful for law undergraduates, and for those studying contract law as part of a course in another discipline. The author has made particular provision for non-law students by including an introduction to the English legal system and its place in the European Community framework. This edition has been updated to reflect developments in the law of contract in the two years since the last edition was published. In particular, it examines developments in respect of fraudulent misrepresentation (Smith New Court Securities Ltd v Scrimgeour Vickers Ltd), damages for loss caused by change in market values (South Australia Asset Management Corpn. v York Montague Ltd), reversing the decision of the Court of Appeal in Banque Bruxelles Lambert SA v Eagle Star Insurance Co Ltd, and repudiatory breach (Vitol SA v Norelf Ltd The Sanata Clara). Other areas of judicial activity include the question of damages generally, the developing law relating to undue influence, and the continuing problem of formalities for contracts for the sale of land.
