This new edition of Remedies provides a practical look at the process of identifying and choosing remedial relief and the qualification of damages, and enables students and practitioners to adopt a problem-solving technique. It does not act as a source of substantive law, but has been designed to act as a guide that will enable the user to identify areas for further research in any given case. It offers a broad examination of the whole area of liability and remedies in contract and tort, asking and answering such questions as: What remedies are available? What must a claimant establish to obtain this remedy? What could prevent the remedy being granted? If the remedy is obtained, what will the claimant actually receive? The first part covers the general principles of remedies for breach of contract, tort and misrepresentation, with in-depth instruction on the calculation of damages in personal injury and fatal accident cases.
