Fernandez Arroyo, Professeur a l'Universite Complutense de Madrid, releve en introduction de son cours que les criteres sur lesquels les autorites fondent leur competence pour des litiges relatifs aux affaires privees internationales sont parfois difficiles a justifier. Partant de ce constat, le Professeur Fernandez Arroyo consacre son cours a l'analyse de ces chefs de competence et de leur application, ainsi qu'a l'etude des alternatives qui ont ete proposees et d'autres qu'il propose pour l'avenir. Dans un premier temps, le Professeur Fernandez Arroyo etudie les justifications de l'attribution de la competence judiciaire, puis s'interesse a la theorie et a la pratique relative aux fors exclusifs et aux fors exorbitants. A la suite de ces developpements, il analyse comment sont actuellement traites ces chefs de competence par les legislateurs (internationaux et nationaux et les juges).
