OverviewThis book examines the question of whether, and to what extent, a local authority's termination of a tenancy on the grounds of personal use is permissible under German tenancy law. Such terminations, through which public bodies seek to provide housing for recognised asylum seekers, are caught between the conflicting objectives of freedom of contract and the social protection of tenants. When assessing the permissibility of such a termination, the decisive factor is whether public bodies, as legal entities, can terminate existing tenancies on the grounds of personal use as a legitimate interest. In this context, the following paper examines the general conditions of validity and grounds for termination that must be met for a municipal termination for personal use to be permissible, and uses a selected case study to illustrate both the topicality and the problems associated with this form of termination.
