Overview

The General Norms constitute the first part of the Code of Canon Law, which Pope John Paul II promulgated in 1983 for the worldwide Catholic Church of the Latin tradition. It is applied in some 2400 dioceses in countries with their own legal cultures. This commentary in Dutch, which is largely based on international books and articles, presents the church's legal framework on the sources of law, legislation and custom, on the acceptance of law, on the various acts of government in the church, on their relationship with law, on the power to govern the church and its different functions, on physical and juridic persons, and on the ecclesiastical offices, which enable clerics and laypeople to direct the church. The book offers a good insight into the forces of law, the distinction of powers and the rules on public functions in the Church. A long tradition from the Middle Ages is linked with new approaches since the Second Vatican Council (1962-1965). Dit commentaar biedt oude en nieuwe inzichten omtrent de gelding van de kerkelijke wetten en van andere algemene decreten in de r.k. kerk. Het behandelt de betekenis van het gewoonterecht in een kerk, die uit vele afzonderlijke gemeenschappen bestaat. Het geeft inzicht in de verschillende soorten beschikkingen van de kerkelijke overheid, zoals decreten en bevelen, privileges en dispensaties. Het algemene statuut van de fysieke en van de rechtspersonen wordt uiteengezet. De geldigheid en geoorloofdheid van de rechtshandelingen komen aan de orde. Inzichtelijk wordt gemaakt, wat bestuursmacht in de kerk is, aan wie zij toekomt, en hoe zij ingedeeld, gesreid, uitgeoefend en beëindigd wordt. Ten slotte wordt behandeld, door wie kerkelijke ambten ingesteld worden en hoe zij op verschillende wijzen toegekend worden en bij iemand verloren gaan. R.G.W. Huysmans (geboren 1935 te Eindhoven, Nederland) studeerde Beide Rechten - Utrumque Ius - aan de pauselijke Lateraanse Universiteit te Rome (1960-1966). Sinds 1967 is hij hoogleraar canoniek recht aan de Katholieke Theologische Universiteit te Amsterdam, vanaf 1992 te Utrecht.
