Les pratiques restrictives de concurrence sont au coeur des préoccupations de plus en plus d'acteurs de la vie économique en raison notamment des effets néfastes qu'elles engendrent sur l'économie. Ayant pour principal objectif de rééquilibrer les relations commerciales entre opérateurs économiques, l'article L. 442-1 du Code de commerce constitue la pierre angulaire du dispositif permettant de sanctionner ces pratiques. Souvent décriée, la mise en oeuvre de ce dispositif n'avait pourtant pas fait l'objet avant 2015 d'une analyse susceptible d'apporter aux entreprises et aux praticiens une grille de lecture globale, si bien qu'eu égard à son importance, un bilan de l'application de ce texte semblait des plus intéressants. Après une première édition en 2015, le présent ouvrage vise, grâce à l'analyse exhaustive de la jurisprudence sur une période de 16 ans (entre 2004 et 2020), à permettre à chaque opérateur économique d'apprécier l'équilibre de sa relation commerciale, à travers les conditions retenues par la jurisprudence pour l'application du texte, la qualification d'un manquement et ses conséquences, notamment financières.

Erwann Kerguelen, Deputy General Rapporteur of the Autorité de la concurrence, as of 15 July 202, head Antitrust Unit 3, whose responsibilities include cases involving the distribution sector. He is a food engineer with a Certificate of Aptitude in Business Administration (CAAE) and a Master's degree in Competition and Contract Law. He joined the Île-de-France Regional Directorate for the Economy, Employment, Labour and Solidarity (DIRECTTE) in 2008 as Carrefour's national coordinator in charge of implementing the framework for protection against unfair trade practices. Rapporteur at the Autorité de la concurrence since 2011, and appointed expert in 2017, he has notably worked on the investigation of cases relating to the Auchan/Casino/Metro/Shiever (20-D-13) and Carrefour/Tesco (20-D-22) joint purchasing agreements and participated in the investigation of the decisions sanctioning the floor coverings cartel (17-D-20) and the white goods cartel (18-D-24) He was also involved in investigating the opinion on the assessment of the impact of increasing the threshold of ban of below-cost selling (18-A-14). Jean-Louis Fourgoux is a partner at Fidal. He holds a postgraduate degree (DEA) in business and economic law. He is a member of the Paris and Brussels bars, and is specialized in economic and European law. Jean-Louis is known for his expertise advising clients in complex disputes before the European Commission, French antitrust authorities, and commercial courts on private enforcement litigations. He has particular experience in the retail, media, and energy sectors. He is formaer President of the Board of the French Association for the study of competition (AFEC). Jean-Louis teaches competition law, at Sciences Po Paris and Versailles University. Specialised in economic law, Leyla Djavadi advises and litigates on anti-competitive practices, distribution and consumer law. More particularly, in antitrust, before the French competition authority and the European Commission for cartel and abuse of dominant position cases. She also acts in merger notifications. In litigation, she represents companies in actions for redress of anti-competitive practices (private enforcement) before the courts and has developed a litigation practice in commercial disputes (unfair competition, class actions, distribution networks, franchising, advertising) and consumer law for a varied clientele in industry, specialised distribution and the media. She is a lecturer in competition law at the University of Nantes, master in competition law, since 2010. Leyla Djavadi has been a member of the Board of Directors of the Association of Competition Law Practitioners since 2012 and has been Treasurer since January 2021.
