OverviewThis book examines the legal aspects of real estate market regulation. It provides a definition of real estate in accordance with the Civil Code of the Republic of Kazakhstan and explores the main types of real estate transactions. It outlines the procedure for drafting a purchase and sale agreement, as well as identifies the grounds for invalidating transactions and the consequences of improper performance of a purchase and sale agreement. The author examines the challenges of legal regulation of real estate transactions through the lens of the historical development of legislation, drawing parallels between the laws of the Soviet era, the early period following Kazakhstan's independence, and the present day. Based on the data obtained and using a comparative analysis of the legislation of the Republic of Kazakhstan and the Russian Federation, the strengths and weaknesses of the current legislation are identified. Based on the results of the study, the author makes proposals for the effective improvement of the regulatory legal framework, with the aim of reducing criminal activity in the real estate market.
