OverviewThe new legal practice course marks a shift in focus, from the traditional book learning of the old course towards an emphasis on legal skills gained through practical exercises. This book on lawyers' skills is part of a series which will provide a guide to the law, practice and procedure. Each guide will explain the relevant substantive and procedural law and where appropriate will contain sample precedents, documents and check lists as well as excerpts from relevant practitioner texts. Sample questions and execises will also be included as a stimulus to further reading. The guides will form a bridge between the notes and workbooks produced by each teaching institution and the raw material found in the practitioner texts. There is a guide for each of the compulsory subject areas and for many of the more common optional subjects. There is also a guide devoted to the pervasive subjects and two guides on the skill subjects. This guide on lawyers skills brings together the five skills that are at the heart of the Legal Practice Course and which underpin effective performance as a solicitor - legal research and fact analysis, legal writing, drafting, interviewing and advising, negotiation and advocacy. It advicates the use of a problem-solving framework for legal research and fact analysis, and provides effective methods for organizing the results of research. It identifies the key characteristics of good legal writing and argues that a good writing style should follow from a logical approach to the construction of written work. It sets out the main rules for drafting and provides suggestions for good drafting practice. In its consideration of the lawyers skills of interviewing, negotation and advocacy it emphasizes preparation. The lawyer also identifies the interpersonal skills that underpin each of the lawyering skills and it considers questions of strategy and tactics. The text introduces the student to the latest findings from theoretical research and puts these in a practical setting with a wealth of practical examples and illustrations.
