Overview

This book contributes to current legal and political debates regarding the rule of law, constitutionalism and rights enforcement. The authors explore the context, substance and meaning of constitutionalism in comparative perspective, as well as the influence of constitutionalism to national and global democracy endeavors and the rule of law. They analyze and interpret these issues from the perspectives of those who administer and implement constitutional mandates, such as legislators and judges. But they also examine constitutionalism from the perspectives of those who especially stand to benefit from constitutional provisions, particularly social and economic rights, and their enforcement. The authors individually and collectively provide a rich global constitutional tableau, with chapters covering the USA, South Africa, Australia, the United Kingdom, and Canada. Penelope Andrews (B.A. LL.B (Natal) LL.M. (Columbia), is a Visiting Professor at Valparaiso University Law School (on leave from CUNY Law School). She has also taught at several universities in the USA, Australia, South Africa, Canada, and Europe.She has written extensively on human rights issues in the South African, Australian and American contexts. She is on the editorial board of several law journals and non-governmental organizations, and the contributing editor of The Post-Apartheid Constitutions: Reflections on South Africa's Basic Law. Susan Bazilli (B.A. Hons. (Queens) LL.B. (Osgoode Hall), is currently the Director of the International Women's Rights Project (IWRP) based jointly at the Centre for Global Studies, University of Victoria, Canada, and in Johannesburg, South Africa. She has extensive professional experience in over thirty countries as a lawyer, consultant, researcher, and advocate, focusing on issues of women's human rights, democracy, the rule of law, and international development. She has edited Putting Women on the Agenda and Putting Feminism on the Agenda.
