OverviewThe Information and Consultation Regulations came into force on 6 April 2005. They gave employees new rights to be consulted about important decisions that affect their jobs in organisation with 150 or more employees. This special bulletin explains the basic statutory requirements, looks in detail at the position of companies with and without pre-existing information and consultation agreements, compliance and enforcement, and restrictions on contracting out. It also considers the circumstances in which employers may restrict or withhold confidential information or documents, together with the protection afforded to employees from dismissal and selection for redundancy for taking action in connection with rights under the regulations. Illustrative examples throughout help to explain how the rules operate in practice. The full text of the final draft regulations is included. This Special Bulletin will provide invaluable guidance for employment law advisers and human resource professionals dealing with medium and large organisations.
