OverviewRestrictive covenant clauses are becoming increasingly common in employment contracts. Businesses often seek to minimise the potential harm that can be inflicted by former employees after they leave employment. This thesis provides an overview of German law on contractual clauses that attempt to restrict the ability of a former employee to compete with the employer or to solicit their customers and provides practical solutions for drafting enforceable covenant agreements.
