Overview

Immigration Law and Practice guides students through the complexities of the underpinning legislation and the Immigration Rules, as well as describing some key skills which all immigration practitioners will need. Chapter 1 explains the background and legal framework for the UK immigration system, including its historical development. Chapter 2 describes the procedures for applying to come to or stay in the UK including the entry clearance system, electronic travel authorisation and controls on entry. In Chapter 3 the appeal process against immigration decisions is described, including the legislative framework and the powers of the First-tier Tribunal and the Upper Tribunal. Chapter 4 describes the operation of judicial review in immigration cases, including the procedures and hearings. In Chapter 5 the powers of immigration officers and the Home Office to impose immigration detention are set out. Chapter 6 explains the rules which apply to people who just want to visit the UK without intending to work or permanently settle. In Chapter 7 the law and procedures applying to those wishing to come to the UK to work or study are set out, including the points-based system and the special rules applying to talented individuals and domestic workers. Chapter 8 reviews the rights of partners, children and other close relatives to enjoy family life in the UK with British citizens or other settled family members. The requirements include financial resources and language skills. In Chapter 9 the law governing the controversial area of refugees and asylum is explained. Chapter 10 explains the ways in which British citizenship can be acquired. In Chapter 11 the application of the European Convention on Human Rights to immigration law is described. Chapter 12 deals with the administrative removal of people in breach of immigration law and those who have entered the UK illegally, as well as the deportation of criminals. In Chapter 13 advocacy in the context of immigration hearings and appeal is explained. Chapter 14 covers the drafting of key documents in immigration cases. Finally, Chapter 15 covers the communication skills which immigration practitioners need to develop.

Richard McKee is a barrister specialising in immigration law and a former Judge of the Upper Tribunal. He has written extensively on immigration, asylum and nationality matters, as an editor or contributor to Butterworth’s Immigration Looseleaf Service, Jackson’s Immigration Law and Practice (Bloomsbury Professional) and the Journal of Immigration, Asylum and Nationality Law. He also provides regular monthly updates for Immigration Judges in the First-tier and Upper Tribunals.   Tamana Aziz is a Director in the Private/Business Immigration department at Duncan Lewis Solicitors, having joined in January 2018. She has been providing immigration advice and assistance since 2001.
