Overview

English summary: As one of the three pillars of German and European energy, environmental and climate protection policy, the increase of energy efficiency represents an all-encompassing social challenge - also on a juridical level. This dissertation focuses on the presentation and interpretation of energy efficiency legislation relating to buildings and products. Within this context the inclusion of the Energy Performance of Buildings Directive 2010/31/EU, the draft law relating to the regulation of the Energy Conservation Act of 2013 and the Energy Conservation Regulations of 2013 make an essential contribution to closing a significant research gap. In addition, both building-related as well as product-related energy efficiency legislation is analyzed extensively with regard to European Community Law and Constitutional Law. German description: Als eine der drei tragenden Saulen der deutschen und europaischen Energieumwelt- und Klimaschutzpolitik ist die Steigerung der Energieeffizienz eine allumfassende gesellschaftliche Herausforderung - auch auf juristischer Ebene. Der Fokus der vorliegenden Dissertationsschrift liegt auf der Darstellung und Interpretation des gebaude- und produktbezogenen Energieeffizienzrechts; die Inklusion der Gebaudeenergieeffizienz-Richtlinie 2010/31/EU, des Gesetzes- respektive Verordnungsentwurfs des Energieeinsparungsgesetzes 2013 und der Energieeinsparverordnung 2013 leistet in diesem Kontext einen wichtigen Beitrag zur Schliessung einer essentiellen Forschungslucke. Daruber hinaus wird sowohl das gebaude- als auch das produktbezogene Energieeffizienzrecht umfassend europa- und verfassungsrechtlich untersucht.
