OverviewEnvironmental Liability and the Emerging Art Form of Transference provides a practical overview of the development of environmental law since 1970 and the manner in which it has impacted the redevelopment of contaminated properties for residential and commercial developments. The author, a leading attorney in environmental and energy law, describes in practical terms the new insurance products that may assist parties in the transferal of environmental risk to insurance companies. This book provides a complete summary of the development of liability transfer contracts offered by remediation firms, as well as how new, innovative contracts can provide an attractive alternative to the assumption of risk that is normally associated with ownership of contaminated properties. This book serves as a practical guide for the development and negotiation of these liability transfer contracts for all parties involved in the purchase and sale of contaminated properties, and represents one of the first comprehensive discussions of the new contract methods used to transfer environmental liability to third parties for a fee. Environmental Liability and the Emerging Art Form of Transference is an invaluable resource for those involved in real estate transactions involving redevelopment, or anyone seeking to learn more about environmental law. The author's thorough dissection of liability and transference enables readers to get inside the mind of an expert, as he offers up his thoughts around successful navigation of this expanding area of law.
