Overview

"Based on ""A Practical Approach to Sentencing"" by the late Christopher Emmins, this book provides a guide to the types of sentence which are now available to the courts. It explains the powers of sentencing which can be used and how they are likely to be exercised in practice. The book incorporates all of the changes made by the Criminal Justice Acts 1991 and 1993 and by the Magistrates Association Sentencing Guidelines. Since the first edition of this book in 1985, a great deal of sentencing law and practise has changed. Powers to remove an offender's ill-gotten gains from drug-traffficking and other lucrative offending were introduced in the Drug Trafficking Offenses Act 1986 and the Criminal Justic Act 1988. They have been further strengthened by the Criminal Justice Act 1993. The most obvious development has been the bringing into force in October 1992 of the Criminal Justice Act 1991, a measure designed to re-shape sentencing philosophy and sentencing powers in a much more fundamental way than has previously been attempted. Further changes were also made to the law in the Criminal Justice Act 1993, including the abolition of unit fines after less than a year's operation in the courts. The book offers reading for lawyers who practise in the criminal courts and for magistrates and probation officers. It also provides an introduction to sentencing for students on criminal justice and criminology courses. Martin Wasik is the author of ""Crime and Computer"" and co-author of ""Blackstone's Guide to the Criminal Justice Act 1991"" and author of ""Blackstone's Criminal Practice"". Christopher Emmins was senior lecturer on Criminal Procedure at the Inns of Court School of Law."
