Overview

This book was written in Portuguese and addresses Telecommunications Law and Regulatory Practice of Brazil from the outset of the Brazilian regulatory reforms of the 1960s and 1990s, with the Telecommunications Acts of 1962 and 1997 up to the year 2012. Basic legal concepts on telecommunications services, value added services, Internet and broadband infrastructure are tackled according to the historical developments of the telecommunications sector in Brazil and its changing legal framework. The author is a well-known tenured professor of Constitutional and Administrative Law in the School of Law at the University of Brasilia, director of the Sectorial and Regulatory Law Research Center (www.ndsr.org), and coordinator of the Telecommunications Law Study Group (www.getel.org). Este livro sobre o direito das telecomunicacoes no Brasil foge a tradicional abordagem dos manuais juridicos, que priorizam definicoes e elencos de referencias normativas. Pelo contrario, ele apresenta o direito das telecomunicacoes a partir de sua vivencia institucional, partindo do pressuposto de que a devida compreensao de um ramo de saber juridico e um empreendimento proporcional a intimidade do estudioso com a experiencia regulatoria efetivamente vivenciada no pais. A primeira parte do livro, portanto, dedica-se a exposicao historica da conformacao do regime regulatorio das telecomunicacoes no Brasil, partindo-se do pressuposto de que a melhor forma de se adentrar um novo campo do conhecimento e a de se inserir o leitor no dia-a-dia da regulacao, fazendo-o de testemunha ocular da historia de discussoes politico-juridicas de conformacao das telecomunicacoes. A segunda parte do livro, por sua vez, introduz o leitor nos meandros das definicoes proprias ao objeto do direito das telecomunicacoes, qual seja, o servico de telecomunicacoes, suas classificacoes juridicas e os regimes juridicos delas derivados. Os principios regulatorios das telecomunicacoes, por sua vez, sao meramente esbocados neste livro para aprofundamento futuro.
