Overview

Die Societas Privata Europaea (SPE - ""Europa-GmbH"") kommt. Wird die deutsche GmbH-Reform (MoMiG) obsolet? Überlagert von der Aufmerksamkeit, welche das MoMiG im Jahr 2008 beherrschte, hat der am 25.6.2008 von der Kommission der Europäischen Gemeinschaften vorgelegte Vorschlag für eine Verordnung des Rates über das Statut der Europäischen Privatgesellschaft zunächst kaum Beachtung gefunden. Als in den Mitgliedsstaaten der EU unmittelbar geltendes Recht könnte die SPE aber zu einer ernstzunehmenden Konkurrentin der deutschen GmbH werden.
