Overview

Im 19. Jahrhundert wird das Naturrecht in der Folge von Revolution und Restauration zum besonderen Streitobjekt, als die katholische Kirche dem Rechtspositivismus das neuscholastische Naturrecht entgegenstellt. Nach 1945 erfolgt eine Naturrechtsrenaissance, die auch die deutsche Rechtsentwicklung beeinflusst. Mit der Dissertation von Gerhard Hammerstein ragt eine Naturrechtsanalyse heraus, die ideologische Engführungen meidet und den Kern rechtsethischer und praktischer Norm- und Wertfragen freilegt. Rudolf Uertz hat die bisher unveröffentlichte Arbeit von 1950 überarbeitet, kommentiert und so für sozialethische, politik- und rechtsphilosophische Diskussionen erschlossen.
