Overview"Consumer contract law is changing at a frightening pace. 1994 was a significant year for the development of consumer sales legislation, and saw the enactment of four major pieces of legislation: The Sale and Supply of Goods Act 1994; The Unfair Terms in Consumer Contracts Regulations 1994; The General Product Safety Regulations 1994; and The Sale of Goods (Amendment) Act 1994. The scope of the new legislation is such that it will not only affect lawyers, but all financial institutions (for example, insurance and banking), Trading Standards officers and any manufacting or retail businesses providing a product or service to the public. The main change made by this legislation include: changing the merchantable quality implied condition to one of satisfactory quality, and altering the remedies available in sales contracts; introducing new rules to prevent the use of unfair terms in consumer contracts, which not only render such terms non-binding but also allow the Director General of Fair Trading to obtain injunctions against their use; extending the scope and amending the content of the general safety obligation in Part II of The Consumer Protection Act 1987; and changes to the rules on the passing of title in sales contracts.
