Overview

Council Regulation (EC) No 6/2002 on Community designs (CDR) protects the appearance of a design against counterfeiting and piracy, be it registered or unregistered. The right is applicable throughout the European Union. The registered design will be obtained in a single procedure from the Office for Harmonisation in the Internal Market (OHIM) in Alicante. This commentary gives a detailed article-by-article analysis of the provision of the Regulation and its enforcement in each Member State of the European Union.
