Part Two relates to buying and selling at public auction, including contractual provisions in auction contracts and the mechanics of bidding at auction. Part Three relates to online purchases and sales, and how those differ from retail and traditional auction transactions. Part Four addresses certain types of art and collectibles that may be illegal to own or import into the U.S. Part Five covers resolution of disputes involving art and collectibles, from negotiating with dealers to suing in court. Part Six discusses the tax aspects of buying and selling art and collectibles, including sales and use tax, deductibility of insurance and other expenses, and other issues.

Author Information

Armen R. Vartian and has been working in the art and collectibles industry since 1984.   He founded the Law Offices of Armen R. Vartian in 1991; the law firm concentrates in the areas of art and collectibles law, and has represented dealers, auction houses, collectors, investors, museums, artists, and institutions from throughout the U.S. and abroad. Vartian contributed a bi-monthly column discussing legal considerations in the numismatic publication Coin World for over 20 years, and also contributed articles about the luxury art and collectibles markets for Fortune China. He is a Vice Chair of the ABA Art & Cultural Heritage Law Committee, and is the Editor of, and a frequent contributor to, the Committee’s Newsletter. Vartian graduated from Brooklyn College of the City University of New York in 1978, and Harvard Law School in 1981. Mr. Vartian is a member of the New York, Illinois, and California bars, and is admitted to the U.S. Supreme Court, and numerous federal circuit and district courts nationwide. Laura C. Tiemstra is a partner in the Law Offices of Armen R. Vartian, a law firm that concentrates in the areas of art and collectibles law, and has represented auction houses, grading services, and individual collectors. Ms. Tiemstra is an editor and contributor to the Art & Cultural Heritage Law Committee’s Newsletter, a section of the ABA International Law Section. Ms. Tiemstra graduated from Boston University in 2009 and Indiana University Maurer School of Law in 2012. She is a member of the Illinois and California bars and has been working in the art and collectibles industry since 2012.
