Overview

Band Law for Bands has a simple goal: to help you understand and address the most common legal issues which emerge with a band. This book is not a comprehensive analysis of the legal issues, and given the rapidly shifting dynamics of the music industry, new issues emerge every day involving various digital technologies and new business models. Rather, Band Law for Bands addresses the fundamental issues bands face, including entering into a partnership agreement, song ownership rights, licensing issues, registering copyrights, and negotiating recording contracts. It should become your first source of information when your band confronts a legal issue.

Author Information

Barry Irwin is a lawyer who, for the last twenty years, has primarily practiced in the area of intellectual property litigation. He has first-chaired many high-stakes patent, copyright, trademark, trade secret, restrictive covenant, unfair competition and antitrust matters. He has served as a member of Lawyers for the Creative Art's Board since 2010. In 2010, LCA awarded Barry's law firm, Kirkland & Ellis LLP, its Law Firm of the Year Award. Barry's pro bono efforts were highlighted as a major reason for the award, which Barry accepted on behalf of Kirkland. Barry has been legal counsel to numerous bands and musicians, addressing music law related issues ranging from drafting partnership agreements, preparing copyright filings, negotiating recording contracts, litigating termination of recording contracts, and winding up band assets upon dissolution. Barry's copyright practice has also involved a diverse range of media, including books, music, software, and lawn statuary. Barry received his B.S. in Aerospace Engineering from the University of Notre Dame in 1988. He received his J.D. from the University of Notre Dame Law School, magna cum laude in 1992. Barry is also an Adjunct Professor at Notre Dame Law School, where he teaches Patent Litigation and Entertainment Law. Jason Koransky is an associate in the intellectual property litigation group at Kirkland & Ellis LLP, where his practice focuses on copyright, trademark, and false advertising law. Prior to becoming an attorney, Jason (an amateur trumpeter) worked as a journalist in the Chicago area, and was immersed in the music industry for more than a decade as the editor of the jazz and blues magazine DownBeat. Jason received his B.S. in journalism from Northwestern University in 1996 and his J.D. from the John Marshall Law School in 2010.
