English summary: Limits to Power and Capacity of Administrative Jurisdiction After the recognition of discretionary administrative powers without normative authorisation in the Federal Constitutional Court's Rotmilan decision, the doctrine of normative empowerment shall be replaced by the system of limits to power and capacity of administrative jurisdiction. This consistently determines the breaches of the principle of full review from the perspective of administrative jurisdiction and unites them with the categorical system of discretionary administrative powers. German description: Die verwaltungsgerichtliche Kontrolldichte gehort zu den umstrittensten Bereichen des Verwaltungsrechts. Die im Rotmilan-Beschluss des Bundesverfassungsgerichts getroffene Feststellung, administrative Letztentscheidungsbefugnisse konnten auch ohne eine normative Ermachtigung bestehen, ist mit der normativen Ermachtigungslehre nicht vereinbar. Deshalb sollte diese durch das System der Aufgaben- und Leistungsgrenzen abgelost werden. Hierbei sind die Durchbrechungen des Grundsatzes der Vollkontrolle konsequent aus der Perspektive der Funktion der Verwaltungsgerichtsbarkeit zu bestimmen. Gleichzeitig kann es hierdurch gelingen, die dogmatisch inkonsistente, durch die Gegenuberstellung von Ermessen und Beurteilungsspielraum gepragte, kategoriale Systematik administrativer Letztentscheidungsbefugnisse insbesondere im Bereich der Beurteilungsspielraume aufzubrechen und in die Aufgaben- und Leistungsgrenzen als einheitlichen Rechtfertigungs- und Kategorisierungsansatz zu integrieren.
