OverviewExcerpt from An Essay on Trusts and Trustees: In Relation to the Settlement of Real Estate, the Power of Trustees, and Involving Many of the Most Abstruse Questions in the English and American Law of Tenures The law of trusts and trustees, and on the various topics connected with them; this has been done already by several authors, such as Gilbert, San ders, Cornish, Willis, Wilson, &c.; but merely to illustrate some important points; for which reason, it is nothing more than what it professes to be - an Essay. But it is an essay in a kind of learning, perhaps, the most abstruse that ever racked the human brain. The doctrines of uses and trusts, of estates tail of remainders and re versions, of powers and estates by implication of law, of springing uses, resulting trusts, and other topics of a kindred nature, connected with the tenure of real estate, under the common, and equity law of England, are so excessively subtle, that they may be regarded as the equations and conic sections of the system.
