OverviewTo date, the comparative legal aspects of defence counsel's participation in adversarial proceedings under the legislation of other states have not been sufficiently researched. There are virtually no academic works (with the exception of a few articles) examining the specific features of defence counsel's participation through the lens of adversarial proceedings. This work presents a comparative analysis of criminal procedure in the Republic of Tajikistan and the Federal Republic of Germany regarding the participation of defence counsel through the lens of adversarial proceedings, which was conducted at the Munich Institute for Eastern Law e. V. of the Research Centre for Eastern and South-Eastern Europe in Regensburg, Germany. The work addresses issues concerning the emergence, development and significance of the adversarial principle in criminal proceedings. It also examines in detail the important issue of the role of the defence lawyer at various stages (pre-trial, trial, appeal and enforcement of sentence) of the criminal process.
