OverviewThe opposition has not always been a feature of the African political landscape, at least not in a formally recognised capacity. It was only with the advent of democratic renewal in Benin in 1990 that the foundations for the liberalisation of the political sphere were laid and consolidated through the adoption of the Constitution of 11 December 1990, which incorporates principles such as a multi-party system, the promotion and protection of human rights, and subsequently the recognition and respect for the opposition. More than three decades later, the effective protection and constitutionalisation of the political opposition in French-speaking sub-Saharan Africa, particularly in Benin, still give rise to serious concerns and debate, in that discussions on the legal framework guaranteeing the opposition's rights are largely focused on strengthening it. This study, entitled 'The Legal Status of the Opposition in the Republic of Benin', follows the same line of reasoning. The aim of this research was to identify the shortcomings in the legal framework for the protection of the Beninese political opposition and to propose some potential solutions.
