Overview

The Care Bill (HL) contains provisions relating to adult care and support, care standards, health education and research. It will give effect to the policies requiring primary legislation that were set out in the White Paper Caring for our future: reforming care and support (Cm 8378, July 2012, ISBN 9780101837828), to implement the changes put forward by the Commission on the Funding of Care and Support, chaired by Andrew Dilnot, (2011, ISBN 9780108510847) and to meet the recommendations of the Law Commission in its report on Adult Social Care (Law Com 326, HC 941, May 2011, ISBN 9780102971682) to consolidate and modernise existing care and support law. The Bill also gives effect to elements of the Government's initial response to the Mid Staffordshire NHS Foundation Trust Public Inquiry - Patients First and Foremost: the initial Government response to the Report of The Mid Staffordshire NH S Foundation Trust Public Inquiry (Cm 8576, ISBN 9780101857628) - that require primary legislation. The Bill has four parts. Part 1 sets out the legal framework for the provision of adult social care in England. Part 2 of the Bill deals with a number of the aspects of the Government's response to the findings of the Report of the Mid-Staffordshire NHS Foundation Trust Public Inquiry. Part 3 establishes Health Education England (HEE) and the Health Research Authority (HRA) and as non-departmental public bodies. Part 4 deals with various technical matters such as consequential amendments, orders and regulations, commencement and extent of the Bill.
